Acceptance of Terms
Welcome to Malt! These Terms of Service (“Terms”) are a legally binding agreement between you and Malt (the “Company,” “we,” or “us”). By creating a Malt account or using any Malt services, you agree to comply with these Terms, including all policies referenced herein. This includes our Privacy Policy (which explains our data practices) and our Intellectual Property Policy (including the DMCA copyright takedown process), which are incorporated by reference. If you do not agree, you must not use Malt.
We may update or modify these Terms from time to time. Changes take effect when posted (or on the date specified). If a revision is material and could negatively affect you, we will make reasonable efforts to notify you in advance (for example, via email or a notice on our site). By continuing to use Malt after updates, you accept the revised Terms. If you do not agree to the changes, you should stop using Malt and may delete your account.
Artist Accounts Only: Malt is a platform exclusively for musical artists (including bands, solo musicians, DJs, producers, and other creators of audio content) or their authorized representatives. By registering an account, you represent and warrant that you are an individual artist or an agent authorized to act on behalf of a musical artist or group. If you create an account on behalf of a band, label, or other entity, you must have the authority to bind that entity to these Terms, and all references to “you” include both you and the entity.
Age Requirement: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create a Malt account. By registering, you affirm that you are of legal age to form a binding contract and that all information you provide to us is truthful and accurate. If you are under 18, you may not use Malt without a parent or legal guardian’s involvement (in jurisdictions where such use is permitted by law).
We reserve the right to refuse service, suspend, or terminate any account if you do not meet these eligibility requirements or if you violate these Terms. Use of Malt is void where prohibited by applicable law.
Creating an account may require providing certain personal information. You agree to provide accurate, current information during registration and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Do not share or transfer your account to others without our consent. If you believe your account has been compromised, notify us immediately. We are not liable for any loss or damage arising from unauthorized use of your account.
Your Content: “User Content” means any content that you submit, post, upload, or otherwise make available on Malt, including audio files (sound recordings), music, music videos, embedded third-party media, images, artwork, profile information, text (such as bios or descriptions), and any other materials or information. As an artist, the User Content you post will primarily be your music and related materials on your public Malt profile page.
Ownership: You retain all ownership rights in and to your User Content. Malt does not claim ownership of your music or other content – you are not signing over your rights by using our service. Except for the limited license you grant us below, you continue to own and control your content. We acknowledge that your songs, recordings, and creative works are your intellectual property, and nothing in these Terms transfers any ownership to Malt.
Your Responsibility for Content: You are solely responsible for all User Content you make available through Malt. This means you must own or have all necessary rights, licenses, consents, and permissions to post or stream each piece of content that you upload or embed on Malt. You agree not to upload or share any content on Malt unless you have all appropriate rights to do so (for example, you wrote and recorded the music, or you have written permission from all relevant rights holders). Unauthorized content (including unlicensed cover songs, samples, or any material you don’t have rights to) is strictly prohibited. If your content includes third-party material (e.g. you are embedding a third-party player or someone else’s content), you must have the rights or authorization to do so, and by posting it you confirm to Malt that you have those rights.
